Wagglyn provides bespoke foreign exchange consultancy services, including the design and delivery of institutional-grade algorithmic FX trading systems and supporting infrastructure. Our services are provided on a referral-only basis.

2. Eligibility

Our services are intended for institutional clients, professional investors, and sophisticated individuals who meet applicable regulatory requirements. By using our services, you represent and warrant that you meet the eligibility criteria and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of our services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You agree to maintain the confidentiality of all proprietary information, trading strategies, and technical details disclosed to you in connection with our services. This obligation survives termination of these Terms.

7. Risk Disclosure

Foreign exchange trading involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results. You should carefully consider your investment objectives, level of experience, and risk appetite before engaging with our services. You acknowledge that:

• Trading in foreign exchange markets carries a high level of risk
• You may lose more than your initial investment
• Algorithmic trading systems may malfunction or produce unexpected results
• Market conditions can change rapidly and unpredictably

8. Limitation of Liability

To the maximum extent permitted by law, Wagglyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the fees paid by you to Wagglyn in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Wagglyn, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or in connection with your use of our services or violation of these Terms.

10. Termination

We may suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
